deposition

Post by admin »

We will be having our deposition soon, can anyone tell me exactly what it was like. I am very nervous because I have heard horrible things about it. Thank you in advance.

Just had ours a couple of weeks ago. It really wasn't bad at all...but our opposing attorneys weren't jerks. Ask your attorney what he/she thinks...our attorney was right on ... he was pretty sure they wouldn't be jerks. It isn't something I would like to do again, but it didn't kill me. Was kind of interesting to see where the other side was coming from. We sat around a big table with our attorney, our co-counsel, 2 attorneys for the doctor and the court reporter. Mine lasted 4 hours, hubby's lasted 1 hour.

My deposition was six straight hours. I have a medical background so I knew details of my delivery. She was also my third and she had a severe injury. I think this is why it took so long. It was hard but also I finally felt like I was doing something! Good luck and just take your time answering the questions and if you don't know, don't guess! Good luck.

Never having been in your position I can only guess how worried your are...
I have one important suggestion.
Take your time, don't let them rattle you, if your are unsure how to answer stop and think and try not to become so emotional that they fluster you.
You know you are right and doing the right thing so say a little prayer before you enter for protection and wisdom and justice.

Kath - your suggestions are so good and true. As far as what it is like - their lawyer will be asking you direct questions about your pregnancy, the birth, after the birth, and your lawyer will be there with you. If you need a break from the questioning you can just tell them that you'd like a break. If you do not know an answer just say that you do not know or you are not sure. Also - do not give more information than you are asked for (because it can lead to further questioning and/or get confusing). Just answer the question. I unintentionally rambled on some of the answers and that's probably why my questioning took so long! Be honest and remember that you did nothing wrong so you have nothing to hide. It's the other side that should be worried - not you.
