Can you share ideas on depositions?

We have our first experience of depositions coming up. Hopefully, our attorney will fill us in soon, but was wondering if you could share some of your experiences with what goes on at depositions? What kind of questions do they ask? Do they try to make you stumble on your answers or emotionally upset you? Are they really into details? I am scared I won't be able to keep it together and that it will all hit home and get to emotional. I can't even imagine watching the doctor and nurses just lying - it is going to kill me! I do plan on going just to see it with my own eyes.

We were not prepared at all for our depositions and they lasted 8hrs. I love to be able to share our experience with you. If you give me your e-mail I will send you my phone #. If I can help at least one person from going through what we went through its worth it.

Sorry, but can someone explain all the secrecy? If you go to the deposition with the truth, keep it simple, only answer their questions with confidence,what is their to be afraid of? You have your childs injury, medical records that support his injury. After that you pray you hired the right lawyer and let the lawyers play their little word game. You stick to the truth and never doubt yourself and you will do fine. Yes, I had my deposition a while ago and I am looking forward to my court day this month. You walk in there with your head held high, well rested and confident. Good luck!

Patty hit the nail on the head. Before mine, I had started to panick and worry, not ever going through anything like this before. But then I realized I had nothing to worry about, all there is - is the truth. I think the key for me was to stay focussed and not let the opposing attorney try to mix my words and to take my time answering questions. Make sure you hear the question and don't get caught up in quick back and forth. It really wasn't as bad as I had thought and felt some vindication getting the truth documented. I also sat in and watched the OB's depo. That was harder than going through mine. But I have no regrets. We settled our case in June and we are extremely happy with the process and outcome. Hi Julie,

Congratulations on your settlement. I wanted to ask you how you felt about settling verses taking it to court. Did you feel relief it was over without the stress of a trial or did you feel shorted of the experience to vent in front of the jury? I guess I would be happy to end the whole thing without a trial, but then I think I would feel shorted and the doctor would never be forced to face his crime other than in money damages. I have mixed feelings about the whole thing. I geuss I still need closure by telling him how disapointed I am in him. Does that make sense? I guess the bottom line is to follow the lawyers advice and walk away, maybe even get some therapy for myself after all of it is over! LOL

I feel that the secrecy is needed though, we have a pending case in litigation even as we speak. A friend of ours who we met because of an obpi had her life turned upside down because of her law suit....so the less people that know the better.....They did a deposition with just about anyone she came in contact with....for the first two years of her babies life !!!It was horrible
