Although a "win" in court would have been nice, I too think you have the BEST WIN!!! To know that she cannot hurt another child is awesome. Bless you! Look ahead and take a day at a time. It will all work out.

we are just about to start this crappy thing and i am wondering if you have any advise for me? if it is to soon i understand!! did you have any pic, video or are from a small state? i am so curious to why it went the way of the doctor? we need more proof that this ONLYthe doctors fault in EVERY case!!!!! is there anything that you can help me with? i live in a very populated state and i have found that people who live in smaller areas have a harer time winning against these HORRIBLE docs!!!!

Yes, that is a huge win......my son's doctor practice to this day, eight years later and are still injuring baby after baby.....HORRIBLE. ANd to think we settled out of court !! Will be praying for you and your family during this difficult time !!!!! GAYLE

Dear Dani,
We lost our trial as well, almost a year ago this month. It was absolutely terrible. You will get through this, as my family has as well. I don't usually post much, but I know exactly how you feel, it's not fair, your child deserves to be compensated, how can this be, you want the world to know about the doctor, just know you are not alone and you will get through this.

Sometimes I feel as if the only people who actually "win" are the lawyers! They pressure you to settle because they for sure want a "paycheck" at the end of all "their hard work." What a joke!

I'm sorry you feel so negative towards your lawyer. The success rate for brachial plexus lawsuits by trial is only 40%. I think lawyers encourage settlement because they know this. If you settle, you get something; if you go to trial and lose, you get nothing. And that means nothing for your child, nothing for future compensation, nothing for future surgeries.

I will say it again: there is no "closure" in a lawsuit. If you are looking to "close a book" or "face the doctor", you are really not looking in the right place. A civil lawsuit is for damages. "Closure" comes from within. You have to get to that place on your own (or with a therapist).

Dani, when your child grows up and you retell the stories of old, I think he will be so happy to know that you stopped this doctor from practicing and saved so many babies from being injured. I hope in time that you can be proud of this outcome.
