I was very happy to see that some of you have actually won a law suit. This was my second child and my first was caught in the birth canal also. Thank goodness her shoulder was only dislocated. My dauther is 10 yrs. old and in 2000 we lost our case aganist the doctor.
I was so shocked!!
Haley was almost 5 weeks early, at 8 lbs and 1/2 ounce. I told my doctor the entire time that my first delivery was very difficult and I was told to never have a vaginal delivery again. His response was every pregancy is different. But we'll watch it very close. He said he couldn't get the records from the military hospital, but, I DID.
Haley was so critical from the delivery ( with head, neck and arm trauma.) We could not touch her until she was 5 days old. (I mean not even a finger) We didn't learn of the erbs palsy until she was a little over a a week old.
Haley has been seen by specialist, OT's and PT's.
She has had surgery at age 5 to try to give her more function.
The attorney for the doctor made it look like their was nothing wrong with her and even had her doctors state she was fine, only a little trauma, and this was done to save her life.
It has been 10 yrs of therapy, specialist, and still no great function. Haley's C-5 and C-6 are paralized. I am very happy she is fine but it makes me mad when a doctor gets away with this type of malpractice.
