JURY VERDICT: NEGLIGENT

wow it's been such a long long time that i haven't been on the message boards. i have a seven, almost eight, year old daughter (Rachel) with erb's palsy on her left arm. we have been in litigation for over seven years. we lost our first trial but were awarded a second trial. we just finished our trial. it took two and a half weeks and the jury found the doctor negligent. finally after so many years of fighting for our daughter we finally received justice. my daughter was awarded almost 3.3 million dollars but we took a "high/low" settlement. nevertheless, it took us years but we finally got justice for our daughter. We had a wonderful attorney who was not only great at his job but was personable and caring. i'm posting this to encourage everyone to keep hanging in there. keep fighting. if anyone has any questions about our trial we will be happy to answer them. just email us directly. sarah.

Congratulations!!! I know the feeling. we went through a jury trial once and they found the doctor that delivered our daughter negligent also! Now the weight is lifted...I am very happy for you!

Good for you. We went to trial for our daughter, settled for just under what the law provides for damages, avoided a trial. She will have money for college [soon]. At that time, we were advised that there was nothing to be done for her except occupational therapy. Things have certainly changed! We were told surgery was not possible until she turned 15 years old--and now, surgery for babies! I am so thankful that we continue to have these medical improvements.
